Healthcare
The government's new HIPAA Enforcement has begun and 1/3rd of violations involve "Business Associate." A Business Associate is anyone that a physician works with who has access to PHI. This typically means a physician's professionals, including accountants and attorneys. Having a Business Associate Agreement in place is a requirement under HIPAA. Failing to have one may cause a fine; however, a well written agreement protects you from breaches by service providers.
Tax
Tax Court Finds FLiP Valid Estate Planning Tool. The Tax Court upheld the FLiP as an effective estate planning tool in In re: Estate of Stone v. Comm'r (T.C. Memo. 2012-48). The Tax Court found that real estate properly transferred to a FLiP was not part of the decedent's taxable estate for wealth transfer tax purposes. The finding is the latest to validate the FLiPing IDIT as an estate planning and asset protection device and the first to do so on non–income producing property.
